Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, services, and platforms owned and operated by NSDMT Ltd T/A The Label Machine ("The Label Machine," "we," "our," or "us"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree with these Terms, do not use our services.
1. Services Provided
The Label Machine offers educational programs, mentorship services, software tools, music distribution services, and digital resources for music artists, record labels, and other creative professionals. These may include but are not limited to:
- The Label Machine Accelerator Program
- The Marketing Machine platform
- The Label Machine Community access
- Distribution services
- Digital tools, templates, and content libraries
Services are offered on a program basis or via time-limited or subscription-based access, as outlined on your purchase page.
2. Account Registration and Access
To access certain features, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials. You agree not to share your account or login credentials with others. We reserve the right to suspend or terminate your account if you violate these terms or misuse the service.
3. Access Rights and License
You are granted a limited, non-exclusive, non-transferable license to access and use the services for your personal or business use as permitted under your specific program or subscription.
- Lifetime access refers to access to The Label Machine community and Accelerator Program materials for the duration of the program’s availability.
- Access to tools such as the Marketing Machine and Distribution platforms is limited to 12 months from the start date of the Accelerator Program or subscription and may require a separate ongoing subscription thereafter.
You may not reproduce, distribute, modify, or create derivative works from any part of the service without our express written consent.
4. Payment Terms
All payments must be made in full and on time according to the plan or agreement you opted into. Failure to complete payments may result in suspension of access to all services until the balance is cleared.
Partial payments do not entitle you to full access unless otherwise agreed in writing. Any agreed payment plan must be adhered to with defined monthly instalments. If payments are missed or delayed, access may be paused until the account is brought up to date.
For monthly subscription services, such as ongoing access to the Marketing Machine platform after the initial 12-month period, billing is recurring until cancelled. Subscriptions can be cancelled at any time, with access continuing until the end of the billing period. No refunds are issued for unused time within a billing cycle. By subscribing, you authorise us to charge your designated payment method on a recurring basis.
We reserve the right to change pricing or service features at any time, with notice given for active subscribers.
5. Distribution Services
By using our music distribution services, you grant The Label Machine the non-exclusive right to distribute your music content (including audio, metadata, and artwork) to third-party digital service providers (DSPs) such as Spotify, Apple Music, Amazon Music, and others.
You retain all ownership rights to your music. You are solely responsible for ensuring that all content you submit for distribution is original or properly licensed and does not infringe upon the rights of any third party.
The Label Machine is not liable for the actions or policies of any third-party DSP. Payouts from DSPs will be issued based on reporting and payment schedules set by those platforms. The Label Machine may charge an administrative or service fee on royalties received depending on your plan or agreement.
We reserve the right to remove distributed content at our discretion, particularly in cases of copyright infringement claims, inappropriate material, or violations of these Terms.
Copyright Takedown Policy and Indemnity
If you believe that any content distributed through The Label Machine infringes your copyright, you may submit a takedown notice by contacting support@thelabelmachine.com with the following information:
- A physical or electronic signature of the copyright owner or person authorised to act on their behalf
- A description of the copyrighted work you claim has been infringed
- A description of the content and its location within our systems
- Your contact details, including address, phone number, and email address
- A statement by you that you believe in good faith that the disputed use is not authorised by the copyright owner, its agent, or the law
- A statement by you, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorised to act on their behalf
By using our distribution services, you agree to indemnify and hold harmless NSDMT Ltd T/A The Label Machine and its affiliates, employees, and partners from any claims, damages, liabilities, and expenses (including legal fees) arising from content you submit, distribute, or make available through our platform, including but not limited to claims related to copyright infringement, defamation, and violation of any third-party rights.
6. User Conduct
You agree to use the services lawfully and respectfully. You must not:
- Use the services for any fraudulent or unlawful purpose
- Harass or abuse other users
- Upload or distribute any offensive, harmful, or illegal content
- Attempt to gain unauthorized access to our systems or interfere with our infrastructure
We may suspend or terminate your access if you breach these rules.
7. Intellectual Property
All content provided by The Label Machine, including video materials, documents, software tools, branding, and visual assets, are protected by intellectual property laws and remain the property of NSDMT Ltd or its licensors.
You may not copy, resell, or redistribute these materials without prior written consent.
8. Refund Policy
All sales are final unless otherwise stated. Any exceptions, such as for technical issues or early cancellations, are at the sole discretion of The Label Machine. Refunds are not granted for change of mind or partial usage of services.
9. Service Interruptions and Changes
We reserve the right to update, modify, suspend, or discontinue any part of the service at any time. In the event of maintenance, upgrades, or technical issues, we will aim to provide reasonable notice and minimise disruptions.
10. SMS and Text Messaging Services
We may use SMS or text messaging to send appointment reminders, confirmations, or service-related updates. You can cancel the SMS service at any time by texting "STOP" to the shortcode. Upon sending "STOP," you will receive a confirmation message, and no further SMS messages will be sent unless you opt back in.
If you experience issues with our messaging service, reply with "HELP" or contact us at support@thelabelmachine.com.
Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. You will receive texts only as necessary to support your service engagement. For questions about your text or data plan, contact your wireless provider.

11. Disclaimers and Limitation of Liability
The Label Machine makes no guarantees of specific results from use of its programs or tools. Services are provided "as is" without warranty of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts in the United Kingdom.
